OFFICIAL RULES FOR “GRAND THEFT AUTO 4 XBOX CONTEST”
THE FOLLOWING PROMOTION IS INTENDED FOR THE UNITED STATES ONLY (EXCEPT RHODE ISLAND). DO NOT PARTICIPATE IN THIS PROMOTION IF YOU ARE NOT A LEGAL U.S. RESIDENT AND ARE NOT 18 YEARS OF AGE OR OLDER. VOID IN PUERTO RICO, ALL U.S. TERRITORIES AND POSSESSIONS, OVERSEAS MILITARY INSTALLATIONS AND THE STATE OF RHODE ISLAND.
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE SHALL NOT INCREASE YOUR CHANCES OF WINNING.
HOW THE PROMOTION WORKS: The Sponsor of this promotion is Giant Magazine LLC, 50 E. 42nd Street, 14th Floor, New York, NY 10017(“Sponsor”). Giant Magazine LLC’s “GRAND THEFT AUTO 4 XBOX CONTEST” (the "Promotion") shall start at 6:01PM Eastern Time (“ET”) on Wednesday, April 30, 2008, and shall end at 5:00 PM ET on Friday, May 9, 2008. Sponsor shall give away 1 (one) Grand Theft Auto designed XBOX to a participant who, in accordance with these Official Rules, registers to enter the Promotion for a chance to win, and correctly answers the three contest questions posted on the contest website.
ELIGIBILITY: This Promotion is only open to legal residents of the United States (excluding Puerto Rico, all territories and possessions, overseas military installations and the State of Rhode Island), who are at least 18 years of age at time of entry and had Internet access prior to Wednesday, April 16, 2008. Employees, officers and directors of Sponsor, and Raw Feed, (Collectively the “Promotion Parties”) their respective affiliates, subsidiaries, parent companies, advertising, promotion, fulfillment and marketing agencies, and members of their immediate families (defined as spouse, child, sibling, parent, or grandparent) and members of any of their households are NOT eligible to participate in the Promotion.
Persons who have won a prize in another contest or promotion of any kind from the Sponsor of this contest within the ninety-day (90) period immediately preceding the start date of this contest are not eligible to participate.
HOW TO ENTER: Beginning at 6:01 PM ET on Wednesday, April 30, 2008, log on to Sponsor’s website located at www.giantmag.com (“Website”) and follow the instructions at the Website to register for the Promotion. During the registration process, contestants will be required to correctly answer three questions about the Grand Theft Auto games that will be posted on the website. Sponsor may require the following information to register: your first and last name, complete address, state, zip code, telephone number, e-mail address and age. All online entries must be received by 5:00 PM ET on Friday, May 9, 2008. There is a limit of one (1) entry per person per drawing. All other entries submitted by that person for that drawing shall be void. Once submitted, all entries become the sole property of Sponsor and none shall be returned to participant.
PRIZES: One (1) prizewinner shall receive one (1) “GRAND THEFT AUTO 4 XBOX” game console bundle with special controllers. Sponsor reserves the right to substitute a prize for one of equal or greater value at its sole discretion. All taxes, fees, and surcharges on the cash card won, or any other expense not explicitly stated herein.
Winner will be notified when their prize is available for pick-up. Winner will be instructed to come to the offices of Giant Magazine located at 50 E. 42nd Street, 14th Floor, New York, NY 10017.
SELECTION OF WINNERS: The winner shall be selected on Monday May 12, 2008 in a random drawing from among all eligible entries received that have provided correct answers to the three contest questions posted on the website and shall be notified via e-mail using the e-mail address provided during contest registration (“E-mail notification”). Odds of winning a prize in a specific drawing depend on the number of eligible entries received for that specific drawing. The prizewinner has one (1) day from issuance of Sponsor’s prize E-mail notification to respond, verifying eligibility. Non-compliance with these Official Rules, or, if a selected potential winner cannot be contacted for any reason, provides an incorrect email address, is otherwise ineligible (as determined by Sponsor in Sponsor’s sole discretion), fails to claim a prize, or fails to timely respond to the E-mail notification, as required, or if the prize notification or confirmation or prize is returned as undeliverable for any reason, the potential winner shall be disqualified and an alternate winner selected. By participating in the Promotion, the winner, authorizes Sponsor and their respective designees to list their first initial, last name, city and home state in a general Promotion winner’s list. By participating in the Promotion, each entrant who is selected as a winner understands that such participation constitutes permission for Sponsor and their respective designees to use winner’s name, likeness and statements for advertising and promotional purposes in perpetuity in any and all media now known or hereafter discovered and without any compensation, unless prohibited by applicable law.
All decisions made by Sponsor regarding any aspect of this contest are final.
GENERAL CONDITIONS: By participating in the Promotion, each contestant agrees to release, discharge and hold harmless Promotion Parties and their respective parent companies, affiliates, subsidiaries, retailers, suppliers, agencies, advertisers and attorneys and each of their respective officers, directors, shareholders, employees, attorneys and agents, from any injury, loss or damages of any kind, including, without limitation, death or disability, that may arise out of or relate to participation in the Promotion or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities.
By participating, you agree to these Official Rules (including eligibility requirements) and to the decisions of Sponsor whose decisions are final and binding in all matters pertaining to this Promotion. Void where prohibited by law, rule or regulation. This sweepstakes is subject to all Federal, State and local laws and regulations.
Promotion Parties and their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees, agencies, attorneys and agents, and any and all Internet servers and access provider(s) (collectively the “Releases”) are not responsible or liable for: any incorrect or inaccurate entry information; human, printing or other errors; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer arising from or relating to participation in this Promotion; inability to access the Sponsor’s Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or any other third party web site; or any combination thereof. In the event any portion of this Promotion is compromised by virus, bugs, non-authorized human intervention, fraud, technical failure or other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupts, or impairs the administration, security, fairness, integrity or proper play of the Promotion, Sponsor reserves the right, in its sole discretion, to cancel, modify, suspend or terminate the Promotion. In the event of such cancellation, modification, suspension or termination, a random drawing shall be held to award all remaining prizes from among all eligible entries received prior to such cancellation, modification, suspension or termination.
Sponsor, its subsidiaries, affiliates, and participating promotional parties will not assume any responsibility for any changes in the execution of the contest, including; cancellation of the contest as a result of the occurrence of events not within the control of Sponsor, its subsidiaries, affiliates, and participating promotional parties, such as Acts of God, strikes, terrorists acts or criminal acts of third parties.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE SPONSOR’S WEBSITE OR ANY THIRD PARTY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries shall be deemed made by the authorized account holder of the e-mail address at time of entry. Authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry.
Any information collected by registering to enter the Promotion shall be used only in a manner consistent with these Official Promotion Rules and with the Giant Magazine Privacy Policy available at http://www.giantmag.com/privacy/.
NOTE: The entrant, only at the Website, must make Internet entry. Entries made by any other individual or any entity, and/or originating at any other website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Promotion. The use of any device or computer hardware or software program to automate the entry process is prohibited.
